BRENTWOOD, NEW YORK (April 22, 2024) – A driver was injured after an SUV collided with a guardrail on the Long Island Expressway in Brentwood.
Long Island officials are saying that the collision took place around 4:00 a.m. by Exit 53. A driver in a red SUV collided with a guardrail and overturned on the roadway.
Paramedics were called to the scene in order to help the victim. He was taken to the hospital in order to receive care.
A full investigation remains ongoing at this time.
Guardrails are designed to reduce accident severity. This includes preventing drivers from hitting fixed objects or leaving the roadway. However, many accidents involving guardrails result in serious injury or death. According to the National Institutes of Health, “However, guardrail collisions involving rollover comprised 27% of all passenger vehicle fatalities. Side impacts into guardrails, such as non-tracking vehicles colliding with guardrail ends, accounted for 22% of all fatalities.” There are a number of ways that a defective guardrail may inadvertently contribute to the severity of a crash.
Depending on the facts of any case, the company that manufactured a guardrail could be liable for an accident. Companies have a legal obligation to take steps in order to prevent accidents involving their products. If a guardrail manufacturer creates a product that is unreasonably dangerous, they can be held liable through a civil claim. Many product liability claims will assert design, marketing, or manufacturing defects.
The company or municipal entity that installed or maintained a guardrail could also be liable for a collision. Guardrails are complex products that must be installed by trained professionals. However, in many situations, guardrails are not installed correctly. It is also common for damaged guardrails to not be properly repaired. Several steps should be taken after any guardrail accident.
Car accidents can be one of the most difficult events that people go through in their lives. Guardrail accidents can be much worse. In most situations, insurance providers will blame you and say that you were entirely at fault for the crash. But the truth of the matter is that many guardrail accidents involve dangerous or defective guardrails. If you’ve been injured in a guardrail accident, you may have legal recourse through a civil claim.
