BRONX, NEW YORK (September 4, 2024) – Two construction workers were seriously injured at Orchard Beach Pavilion after the ceiling collapsed on top of them.
New York City officials are saying that the incident took place on Thursday morning. The workers became trapped under a large piece of concrete after the ceiling collapsed on top of them.
Firefighters and paramedics were called to the scene in order to help the victims. They were transported to Jacobi Hospital in over to receive treatment.
The Department of Buildings is investigating what may have caused the ceiling to collapse.
A large portion of workplace accidents occur in the construction industry. According to the Bureau of Labor Statistics, “In 2022, nearly 1 in 5 workplace deaths occurred in the construction industry and 38.4 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for close to half, 47.4 percent, of all fatal falls, slips, and trips in 2022.” Construction companies should take several measures in order to protect their workers.
Property owners and general contractors are held strictly liable for gravity-related accidents under New York State Labor Law § 240/241, commonly referred to as the scaffold law. This includes accidents where a worker falls or is struck by a falling object. For the statute to apply, the worker must have been engaged in the “erection, demolition, repairing, altering, painting, cleaning, or pointing of a building.” It is important that certain steps are taken after any construction accident.
Many of the injuries associated with a construction accident may not be immediately obvious. Certain medical conditions can also worsen over time, especially if they are untreated. Any person that is injured on the job may be able to seek some measure of justice through a civil claim. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
We at Gersowitz Libo & Korek, P.C. extend our best wishes to the workers injured at the Orchard Beach Pavilion. Any person who may have more information about what happened should reach out to OSHA. There needs to be a thorough investigation into what went wrong.
