Liability for New York City Construction Accidents

Falls remain one of the leading causes of worker injury and death in the United States. According to OSHA, “Fatalities caused by falls from elevation continue to be a leading cause of death for construction employees, accounting for 395 of the 1069 construction fatalities recorded in 2022 (BLS data). Those deaths were preventable.” Construction companies should take a number of measures in order to prevent falls.

  • Workers should be provided with personal fall arrest systems when they work at heights above 6 feet.
  • Certain worksites may need guardrails to prevent accidental falls.
  • Workers should be required to wear hard hats in certain areas.

Construction companies and general contractors are held strictly liable for falls in New York under the state’s labor laws. In essence, these entities are responsible for all gravity-related accidents. This includes incidents where a worker is injured in a fall or struck by a falling object. There are a number of very serious injuries associated with falls.

  • Broken bones
  • Head injuries
  • Spinal cord injuries
  • Death

Falls in construction sites are often highly preventable. They tend to be the results of very serious safety lapses at any construction site. For example, a construction company may forgo installing guard rails in order to speed up a construction project. It is important for victims of these accidents and their families to understand that they do have legal rights. They are able to seek some measure of accountability through a civil claim.
