Liability for Manhattan Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured in car accidents every year across New York and the United States. According to the Governor’s Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” Several factors could contribute to any pedestrian accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All drivers in New York have a legal obligation to use caution to avoid colliding with any pedestrian. They must check their blind spots before making turns at intersection and slow down when necessary. If a driver fails to slow down to avoid colliding with a pedestrian, this could form the basis of a negligence claim. Liability for a pedestrian accident could extend beyond any driver, particularly if a vehicle was being used for business purposes at the time of a collision.
