MANHATTAN, NEW YORK (August 9, 2026) – A woman and her infant daughter have tragically died in a New York Harbor boat crash near Liberty Island.
The US Coast Guard said that the accident occurred around 10:25 PM on Saturday. A 22-foot Bayliner speedboat was traveling close to the Statue of Liberty when the boat apparently capsized.
Coast Guard officials were called to the scene of the accident to help all of the victims. A 27-year-old woman and her five-month-old daughter were in the water.
Both were transported to a local area hospital to receive treatment. Sadly, both were pronounced deceased at the hospital.
Investigators are looking into the possibility that the vessel was an illegal charter. The captain of the speedboat is facing charges related to the two deaths.

When any person is injured or killed on a boat in navigable waters, negligence claims will typically be governed by federal maritime law. Among other things, boat operators are expected to exercise reasonable care to avoid causing foreseeable sources of harm. New York law also requires that boat operators operate their vessels in a careful and prudent manner that does not needlessly endanger others, under New York Navigation Law § 45. What follows are some of the important considerations when determining liability for any boating accident.
If a boat operator fails to exercise due care prior to an accident, this could form the basis of a negligence claim. Consider, for example, Kermarec v. Compagnie Générale Transatlantique, 358 U.S. 625 (1959). In that case, the plaintiff was aboard a ship docked in New York City when he tripped and fell on a stairway within the boat. Attorneys for the plaintiff argued that the stairway was dangerous. The US Supreme Court held that maritime law applied because the vessel was in navigable waters, thereby requiring boat operators to exercise reasonable care under the circumstances.
Capsizing accidents can quickly escalate to life-threatening emergencies. Drowning is one of the most common sources of death in any type of boat accident. According to the U.S. Coast Guard’s 2024 Recreational Boating Statistics, an estimated 3,887 boat incidents occurred in 2024. These accidents resulted in 556 deaths and 2170 injuries. An estimated 76% of the fatalities were victims who drowned. Several measures can be taken to help prevent drowning accidents.
Boat safety requires multiple layers of protection that begin with competent operation of any vessel. Functional equipment and adequate preparation for emergencies are also seriously important. Though not required at all times, boat passengers should generally wear life jackets for the duration of their trip. Boat accidents tend to be highly complex events, often involving liability on the part of multiple parties. This is why it is so important that these accidents are properly investigated after any fatality. The family of any person who died in a boat accident is able to seek some measure of accountability through a civil action.
