Liability For New York Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured in accidents every year. According to the Centers for Disease Control, “Higher vehicle speeds increase both the likelihood of a pedestrian being struck by a car and the injury severity. Most pedestrian deaths (60% in 2020) occur on high-capacity urban roads that typically have posted speed limits of 45-55 miles per hour.” There are many factors that could contribute to a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

The vast majority of pedestrian accidents are preventable and involve some amount of driver error. In many situations, drivers are either distracted or simply not paying attention to the road ahead of them. It is important for accident victims to understand that they do have rights. The family of any person who died in a car accident may have legal recourse through a civil claim.
