Thousands of pedestrians are killed or seriously injured in crashes every year. According to the IIHS, “Pedestrian motor vehicle crash deaths have increased 80 percent since reaching their low point in 2009 and account for 17 percent of crash fatalities. The rates of pedestrian deaths in motor vehicle crashes per 100,000 people are highest for people ages 20-69.” Many different factors could contribute to pedestrian collisions.
A police department could be liable if one of their officers is involved in a fatal pedestrian collision. According to New York Vehicle and Traffic Law 1104(e), the drivers of authorized emergency vehicles have a duty to operate their vehicle with due regard for the safety of all persons. When an officer shows a “reckless disregard” for the safety of others they could be liable for an accident during a police pursuit. When officers are not in a pursuit, they must exercise due care to avoid collisions like all other drivers.
