Thousands of people are killed or seriously injured in pedestrian collisions every year in the United States. According to the AAA Foundation for Traffic Safety, βIn 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit-and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975.β There are several factors that could contribute to a hit-and-run collision.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. This includes driving within the speed limit. During periods of inclement weather or heavy traffic, drivers may need to travel well below the speed limit. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain measures are taken after pedestrian collisions.
Pedestrian collisions are usually preventable. They often occur because drivers are not paying adequate attention to the road ahead of them. The family of any person who died in a pedestrian collision may be able to seek some measure of justice through a wrongful death claim. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
