Thousands of pedestrians are killed or seriously injured every year in car accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” There are a number of factors that could contribute to a pedestrian collision.
Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. When a driver fails to yield the right-of-way to a pedestrian, this could form the basis of a negligence claim. The family of any person that is killed in a pedestrian accident may be able to seek some measure of justice through a wrongful death claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the pedestrian that died in this collision. Any person that may have more information about what happened should reach out to police. There needs to be some accountability for what took place.
