Drivers in New York have a legal obligation to use caution to avoid colliding with pedestrians. According to NY Veh & Traf L § 1146, “every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” Many different factors could contribute to pedestrian collision.
It can be difficult to know what to do after any pedestrian collision. Victims are routinely left with life-altering injuries that impair their ability to perform everyday activities. Families may be left without a primary breadwinner. Any person injured due to the negligent actions of a driver may be able to pursue damages through an injury claim. This right extends to the family of any person who dies.
We at GLK Law extend our deepest condolences to the family of the man killed in this pedestrian collision. Any person who may have more information about what happened should reach out to the NYPD. There needs to be a thorough investigation into what went wrong.
