MANHATTAN, NEW YORK (December 5, 2025) – An elderly pedestrian has tragically died in an Upper East Side, Manhattan car accident by Park Avenue and East 91st Street.

Liability for Manhattan Pedestrian Accidents

Drivers in New York have a legal obligation to use caution to avoid colliding with pedestrians. According to NY Veh & Traf L § 1146, “every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” Many different factors could contribute to pedestrian collision.

  • Drivers may fail to check their blind spots and turn into the path of a pedestrian.
  • Drivers may be distracted by their cellphones or conversations with passengers.
  • Drivers may be traveling at an unsafe speed for the prevailing conditions of the roadway.

It can be difficult to know what to do after any pedestrian collision. Victims are routinely left with life-altering injuries that impair their ability to perform everyday activities. Families may be left without a primary breadwinner. Any person injured due to the negligent actions of a driver may be able to pursue damages through an injury claim. This right extends to the family of any person who dies.
