Drivers must use caution to avoid colliding with any pedestrian in the roadway. This may necessitate that they travel well below the stated speed limit during certain periods. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When drivers fail to avoid a pedestrian, they could be held at fault through a civil action. It is important that certain actions are taken after any hit-and-run collision.
The vast majority of pedestrian accidents are preventable. They tend to involve drivers that are speeding or otherwise not properly scanning the road.
