Survivors of Sexual Abuse in New York City May Soon Be Able to Pursue Civil Actions After Previous Denials Due to Statute of Limitations

MANHATTAN, NEW YORK (January 9, 2025) – Victims of sexual abuse in New York City may soon be able to pursue civil claims due to a major development that is happening at City Hall.

Prior to the end of his term, outgoing Mayor Eric Adams issued a veto for a passed bill that would have reopened the lookback window for sexual abuse claims. However, City Council leaders are now working to override that veto.

Many victims of sexual abuse were previously unable to pursue civil claims due to expired statutes of limitations. But the proposed lookback window would change this.

Why the Lookback Window Matters for Survivors

In short, a lookback window is a temporary legal provision that would lift statute of limitation requirements related to pursuing civil claims related to sexual abuse. They are important because many victims of sexual abuse do not come forward until long after the statute of limitations expires. This would not be the first time that lookback window has gone into effect in New York. There was a lookback window following the passage of the Child Victims Act (CVA). A number of lawsuits were filed against various institutions as a result of that law. This includes youth centers, hospitals, and schools. Juvenile detention centers also had many claims brought against them. The Adult Survivors Act also created a one-year lookback window, but that window closed in November 2023.
