Liability for Suffolk County Pedestrian Accidents

Pedestrians lack the protection of enclosed vehicles and are more susceptible to being seriously injured or killed in the event of a crash. According to the National Safety Council, “in 2024, most pedestrian traffic deaths occurred in urban settings (83%), on the open road (75%) versus intersections (25%), and during dark conditions with or without artificial lighting (74%). The largest number of pedestrian deaths occurred on Fridays (1,095), closely followed by Saturdays (1,103).” Multiple factors could contribute to pedestrian accidents.

  • Pedestrian accidents are more likely to happen in the early morning when visibility is reduced.
  • Many pedestrian accidents involve drivers who are intoxicated.
  • Speeding remains one of the leading contributing factors in pedestrian accidents.

If a driver fails to slow down to avoid hitting a pedestrian in the roadway, this could serve as evidence of negligence. When drivers flee the scene of a collision that results in bodily injury, they could also face criminal liability for their actions. Any person injured due to the negligent actions of a driver may be able to pursue some measure of accountability through a personal injury claim. Damages in a personal injury claim can help cover lost wages, medical bills, and pain and suffering.
