Liability For Brooklyn Apartment Fires

Residential fires remain a leading cause of preventable injury and death in the United States. According to Statista, “In 2021, fires in one- and two-family homes accounted for 2,440 civilian fatalities in the United States. In that same year, about 400 civilians died in apartment fires, and 650 civilians died in fires in highway vehicle fires.” There are a number of common causes of apartment fires.

  • Apartment fires often start in the kitchen and may involve unattended cooking.
  • Many apartment fires in New York City were started by faulty lithium-ion batteries.
  • Apartment fires may involve space heaters left near flammable materials.

Property owners have a legal obligation to maintain their buildings in a reasonably safe condition. This includes being compliant with all NYC fire codes. If a property owner has actual or constructive notice of a fire hazard with their building, they must take action. Failing to take action to protect residents could form the basis of a negligence claim. It is important that certain steps are taken after any Brooklyn apartment fire.

  • Eyewitnesses should be interviewed.
  • The source of the fire should be determined.
  • Medical records related to the incident should be preserved.

It can be hard to know what to do after any apartment fire. Victims often suffer very serious injuries. They may also need to contend with the loss of their home. Sadly, though, apartment owners will often deny any responsibility if someone is injured in their building. But the fact of the matter is that many apartment fires are preventable and involve some amount of neglect.
