Liability For East Flatbush Pedestrian Accidents

Far too many people are killed or seriously injured in pedestrian accidents every year in New York. According to the NY Department of Health, “Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” Cities should take a number of measures in order to prevent pedestrian deaths.

  • Cities should heavily enforce traffic violations likely to lead to accidents.
  • Cities should install traffic-calming measures in order to prevent collisions.
  • Cities should study which intersections and roads have the most accidents.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. Victims of pedestrian accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The vast majority of pedestrian accidents are preventable and involve some amount of driver error. For example, many drivers fail to check their blind spots when they make turns. It is important that accident victims understand that they do have rights. The family of any person who died in a car accident may seek legal recourse through a civil claim.
