Liability for Merrick Car Accidents

Drivers in New York must use caution to avoid colliding with other vehicles. According to NY Veh & Traf L § 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” Several other factors can contribute to a pedestrian accident.
  • Drivers are more likely to hit pedestrians when they are distracted.
  • Drivers are more likely to hit pedestrians if they are intoxicated.
  • Drivers are more likely to hit pedestrians at intersections.
  • Drivers are more likely to hit pedestrians in the early morning and late evening hours when visibility is reduced.

If a driver fails to slow down to avoid colliding with any pedestrian, this could serve as evidence of negligence. When drivers hit pedestrians while under the influence of drugs or alcohol, they could also face criminal liability for their actions. The family of any person who died in a car accident may be able to pursue some measure of accountability through a wrongful death claim.
