OSHA Investigation Underway After Worker Seriously Injured Following Valley Cottage Trench Collapse

VALLEY COTTAGE, NEW YORK (April 19, 2026) – A 25-year-old worker was injured in a Valley Cottage trench collapse at a work location by Route 9W and Smith Street.

Rockland County officials are saying that the incident took place around 3:15 PM on Tuesday. A worker was inside of the trench when the walls suddenly collapsed.

That incident buried the worker and left him with critical injuries. Firefighters and paramedics were called to the scene of the accident to help the victim.

He was transported to a local hospital to receive treatment. A full investigation by OSHA remains ongoing.

Liability for Trench Collapse Accidents

Construction companies have a legal obligation to protect workers from reasonably foreseeable sources of harm, including trench collapses. According to the Centers for Disease Control, “Injuries and deaths related to trench collapses continue to happen. From the years 2003 to 2017, there were a total of 373 trenching deaths. More than 80% of those deaths happened in the construction industry. Workers do not often survive trench collapses, but we can prevent them.” Multiple actions should be taken to prevent trench collapses.

  • Trenches should be inspected daily before each use.
  • The walls of the trench should be properly shored and braced.
  • Heavy equipment should not be placed near the outer walls of the trench.

Depending on the specific facts of any case, a construction company could be directly liable for a trench collapse. They could be held responsible through New York Labor Law § 200. This statue is a codification of an employer’s general responsibility to maintain worksites in a reasonably safe condition. Any injured worker may be able to pursue some measure of accountability through a civil claim.
