Investigation Underway After Worker Died in Murray Hill, Manhattan Cherry Picker Accident Near Madison Avenue and Park Avenue

MURRAY HILL, MANHATTAN (January 4, 2025) – A construction worker has tragically died in Murray Hill, Manhattan near the intersection of Madison Avenue and Park Avenue.

New York City officials are saying that the incident took place around 9:15 a.m. on Friday. A worker was going up a cherry picker when they hit their head on a beam.

Paramedics were called to the scene in order to help the victim. Despite those efforts, the worker was pronounced dead at the scene.

A full investigation by OSHA remains ongoing at this time.

Liability for Manhattan Construction Accidents

A large portion of workplace accidents occur in the construction industry. According to the Bureau of Labor Statistics, “In 2022, nearly 1 in 5 workplace deaths occurred in the construction industry and 38.4 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for close to half, 47.4 percent, of all fatal falls, slips, and trips in 2022.” There are a number of common causes of construction accidents.

  • Unprotected edges
  • Struck-by accidents
  • Caught-in/between accidents
  • Electrocutions

Depending on the facts of any case, a construction company could be liable if any worker is injured on the job. Pursuant to New York Labor Law 200, “All places to which this chapter applies shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” There are many ways that a worksite may have been in a dangerous condition.

  • A worksite may have had weak or unstable scaffolding.
  • Workers may not be properly communicating with one another.
  • Workers may not have access to personal protective equipment (PPE).
  • A worksite may have exposed workers to chemical hazards.

The vast majority of construction accidents are preventable. They tend to involve situations where there are safety violations at a worksite. Sadly, though, construction companies will often fight hard to deny liability if someone is injured or killed. This is why it is so important that all construction accidents are properly investigated. The family of any person who died in a workplace accident may have legal recourse through a civil claim.
