A full investigation into the caramel excavator accident remains ongoing.
Many construction workers are killed in construction accidents every year. Many of these accidents involve excavators. According to Science Direct, “About 44 workers are killed each year in the excavation work industry (SIC code 1794), 23 of them in heavy equipment- and truck-related incidents on excavation industry sites.” There are several measures that should be taken to prevent excavator accidents.
Depending on the facts of any case, there could be numerous sources of liability for any excavator accident. For example, a construction company could be liable for an accident if it was the result of a worksite being in an unsafe condition. The company that manufactured an excavator could also be held at fault. Companies may be liable for accidents if they are the result of design defects with their product. There are many design defects that could contribute to an excavator accident.
It can be hard to know where to begin after any construction accident. Many of these accidents are entirely preventable and the results of common safety lapses. Sadly, though, construction companies will often do everything in their power to avoid responsibility when a worker is injured. This is why it is so important that there is a thorough investigation after any accident at a construction site.
We at GLK Law extend our deepest condolences to the family of the worker who died in this Carmel excavator accident. Any person that may have more information about what happened should reach out to OSHA. There needs to be a thorough investigation into what went wrong.
