Worker Injured in East Harlem Construction Accident After Falling Down Hole

OSHA Investigation Underway After Worker Fell Eight Feet Into Mud At East Harlem Construction Site

EAST HARLEM, MANHATTAN (July 8, 2026) – A worker was injured after reportedly falling 8 feet down a hole at an East Harlem construction site along 2nd Avenue.

New York City officials are reporting that the construction accident occurred around 9:30 AM on Wednesday. The worker fell approximately 8 feet into the mud.

Coworkers and firefighters worked to extricate the victim. The injured worker was eventually removed from the hole and transported to a local hospital in stable condition.

A full investigation into the cause of the accident remains ongoing.

Liability for East Harlem Construction Accidents

Falls remain one of the leading causes of serious injury and death for workers in the construction industry. According to the U.S. Bureau of Labor Statistics, “In 2024, there were 1,034 workplace deaths in the private-sector construction industry. Over one-third (389) of fatal injuries in construction were due to falls, slips, and trips, and 95.9 percent of these were falls to a lower level. Construction accounted for almost half (48.8 percent) of all fatal falls, slips, and trips in private industry in 2024.” Construction companies should take several measures to protect workers from falls.

  • Workers should be provided with personal fall arrest systems when they are working at a height of 6 feet or more.
  • Employers should install scaffolding and guardrails in certain locations to prevent workers from falling.
  • Employers should develop a site-specific safety plan that addresses any potential fall hazards.

When a worker is injured in any type of fall on the job, their employer will typically be liable for the incident. Liability will typically flow from the New York scaffold law. Under this law, building owners and general contractors are liable for most accidents that are gravity-related. This includes instances where workers are injured by a fall or a falling object. It is important for victims to consider their legal options with an experienced attorney.
