Worker Died in Linden After Falling into Industrial Vat at Chemical Plant

OSHA Investigation Underway After Worker Died From Falling Into 6,000-Gallon Industrial Vat Containing Mineral Oil in Linden

LINDEN, NEW JERSEY (February 4, 2026) – A worker has tragically died after falling into a large industrial container in Linden at the Bayway Chemical Plant.

New Jersey officials are saying that the accident took place on Monday, January 19. A man was working above a 6000-gallon industrial vat that contained mineral oil.

For undetermined reasons, the worker fell inside of the vat. Firefighters and paramedics were called to the scene to help the victim.

He was eventually extricated from the industrial vat. However, he was beyond medical aid and later pronounced dead.

A full investigation into the accident remains ongoing at this time.

Liability for Linden Industrial Accidents

Business owners in New Jersey have a legal obligation to maintain their work sites in a reasonably safe condition. Pursuant to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.”  Businesses should take a number of actions to prevent workers from being injured in falls.

  • All workers should receive adequate training in terms of recognizing all hazards.
  • Workers should be provided fall protection when they are working at heights of 6 feet or more below a lower level.
  • Employers should provide guardrails and other safety measures in areas where falls are likely to occur.

When a worker dies or is injured in New Jersey, they or their surviving family members are able to seek aid through the workers’ compensation system. An injured worker or their surviving family members may also be able to seek some measure of accountability through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.
