The driver allegedly involved in the crash has since been charged with negligent homicide and reckless driving.
Thousands of people are killed or seriously injured in hit-and-run collisions every year. According to the AAA Foundation for Traffic Safety, βIn 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit-and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975.β There are a number of factors that could contribute to a hit-and-run collision.
Drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. They must slow down and use their horn if necessary to warn pedestrians of their presence. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any hit-and-run collision.
The vast majority of pedestrian accidents are preventable. They tend to involve drivers who are speeding or otherwise not following traffic regulations. Sadly, drivers will often do everything in their power to deny liability after any fatal collision. This is why it is so important that accident victims seek legal counsel as early as possible.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman who died in this collision. Any person who may have more information about what happened should reach out to the police. This was a preventable tragedy that should have never taken place.
