Police were able to arrest the driver they believe fled the scene.

Liability For New York Hit-And-Run Collisions

Thousands of people are killed or seriously injured every year in hit-and-run collisions. According to the AAA Foundation for Traffic Safety, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” Many steps should be taken after any hit-and-run collision.

  • Fragments of the fleeing vehicle should be sought.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to speeding. It is illegal for any driver to travel at a speed greater than what would be safe given the prevailing conditions. Even driving the speed limit could be considered reckless during periods of inclement weather. The family of any person who died in a pedestrian collision may have legal recourse through a wrongful death claim.
