Long Island officials are saying that the incident occurred early Sunday morning. The victim was in the eastbound lanes when she was struck by a 2009 Nissan.

Sadly, she was pronounced dead at the hospital.

Liability for Brentwood Car Accidents

Pedestrians lack the protection of enclosed vehicles and are much more likely to be seriously injured or killed in the event of a crash. According to the National Safety Council, “on the open road (75%) versus intersections (25%), and during dark conditions with or without artificial lighting (74%). The largest number of pedestrian deaths occurred on Fridays (1,095), closely followed by Saturdays (1,103).” Multiple steps should be taken after any pedestrian collision.

  • The police report created after the collisions should be sought.
  • Medical records related to the victim’s injuries should be reviewed.
  • Any person that may have witnessed the collision should be interviewed.
  • The family of any person who died should be interviewed.

If a driver fails to slow down to avoid hitting any pedestrian, this could be construed as negligence. Even if a pedestrian is in the middle of the road, this does not remove a driver’s duty of care to use caution. Any person injured in a pedestrian accident is protected by a number of laws. They or their surviving family members are able to pursue some measure of accountability through a civil claim.
