Investigation Underway After Female Pedestrian Killed in Albany Dump Truck Accident By Central Avenue
ALBANY, NEW YORK (February 15, 2025) – A 63-year-old woman has tragically died in an Albany dump truck accident near Central Avenue.
Albany police officials are saying that the accident took place on Thursday morning. The woman was trying to cross Central Avenue when she was hit by the dump truck.
Paramedics were called to the scene in order to help the victim. Despite life-saving measures, she later died due to the severe nature of her injuries.
A full investigation into the crash remains ongoing at this time.
Dump trucks can be particularly dangerous for pedestrians given their enormous weight and size. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” Dump truck drivers should take a number of actions in order to avoid hitting pedestrians.
All truck drivers have a legal obligation to use caution to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a dump truck driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a civil claim. Victims of dump truck accidents tend to suffer very serious injuries.
The company that a dump truck driver was working for could also potentially be held at fault for a collision. Generally speaking, companies are liable for the negligent actions of their employees who are working within the scope of their job duties. The family of any person who died in a dump truck collision may be able to seek some measure of accountability through a wrongful death claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman killed in this Albany dump truck accident. Any person who may have more information about what happened should reach out to the Albany Police Department. It is our sincere hope that measures are taken to help make the stretch of road safer.
