Thousands of bicyclists are killed in car accidents each year. Urban areas, such as New York City, tend to have higher rates of bicycle accidents. According to the NHTSA, “Bicyclist fatalities tend to occur in urban areas more than rural areas, with urban fatalities accounting for approximately 85% of bicyclist fatalities. The proportion of bicyclist fatalities occurring in urban areas increased from 69% in 2011 to 85% in 2021.” There are a number of common causes of bicycle accidents.
All drivers must do everything that they can to avoid hitting pedestrians and bicyclists. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a dump truck driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. Drivers should take a number of measures in order to avoid hitting pedestrians.
The vast majority of pedestrian accidents are avoidable and involve some amount of driver error. In particular, drivers tend to travel too fast at night, when visibility may otherwise be reduced. Any person who is injured in a pedestrian accident may be able to seek some measure of justice through a civil claim. A pedestrian accident attorney can examine the unique facts of your case and let you know what your legal options are.
