QUEENS, NEW YORK (November 30, 2024) – A woman has tragically died after falling out of a moving Uber as it headed down the Long Island Expressway in Queensboro, Queens.
New York City officials are saying that the incident took place around 1:30 a.m. on Saturday. The Uber was traveling down the Long Island Expressway when a woman fell out of an Uber.
There are reports that the woman may have opened the door before falling out. It remains unclear if any vehicles struck her after she fell out.
Paramedics were called to Queensboro in order to help the victim. Despite lifesaving measures, she was later pronounced dead.
Rideshare vehicles are involved in a number of collisions every year. According to UIC Today, “One-third of ride-share drivers surveyed in a new study reported being involved in a crash while working. Using a cellphone, driving while tired or driving on unfamiliar roads increased the likelihood of a crash, according to the study by University of Illinois Chicago researchers.” There are a number of factors that contribute to rideshare collisions.
All drivers have a legal obligation to exercise due care in order to avoid collisions. There have been a number of instances where rideshare passengers have felt unsafe and exited their vehicles, even while it was moving. Depending on the facts of any case, a rideshare company could be liable for such an incident. It is important that rideshare accidents are properly investigated.
Many lawsuits against Lyft and Uber are based on the legal theory that the driver involved was negligently hired or retained. In other words, a driver was unfit to work, but they retained their position through some amount of negligence. Any person injured in a rideshare collision may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman who died in this incident. Any person who may have more information about what happened should reach out to the NYPD. There needs to be a thorough investigation into what went wrong.
