Liability for Brownsville Pedestrian Accidents

Speeding remains a major cause of motor vehicle collisions across New York and the United States. According to New York Vehicle Code 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” Drivers should take several actions to avoid any pedestrian.

  • Drivers should check their blind spots before making turns at intersections.
  • Drivers should have their vehicles periodically inspected and well maintained.
  • Drivers should continuously scan the road ahead of them for potential hazards.

If a driver fails to slow down to avoid any pedestrian in the roadway, this could form the basis of a negligence claim. Drivers must slow down to avoid pedestrians, even if they are outside of a marked crosswalk. It is important for victims of pedestrian accidents to understand that they do have rights. They’re able to seek some measure of accountability through a civil action. This right extends to the surviving family members of the person who died.
