Liability for Manhattan Pedestrian Accidents

Property owners have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for the safety of all persons whose presence on a property is reasonably foreseeable. If a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. There are a number of steps that property owners should take to prevent accidental falls in certain areas.

  • Work zones should be properly sectioned off away from members of the public.
  • Any area with openings should have warning signs and other barriers to prevent people from accidentally falling in.
  • Worksites should be overseen by a component person who is enforcing all safety regulations.

Depending on the facts of any case, there could be several liable parties for any accident in which a pedestrian is injured. The company that owned or operated any piece of construction equipment could also be held at fault. Construction companies must operate vehicles in a reasonably safe manner. The family of any person who died after falling through an uncovered hole may be able to seek some measure of accountability through a civil claim.
