Property owners have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for the safety of all persons whose presence on a property is reasonably foreseeable. If a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. There are a number of steps that property owners should take to prevent accidental falls in certain areas.
Depending on the facts of any case, there could be several liable parties for any accident in which a pedestrian is injured. The company that owned or operated any piece of construction equipment could also be held at fault. Construction companies must operate vehicles in a reasonably safe manner. The family of any person who died after falling through an uncovered hole may be able to seek some measure of accountability through a civil claim.
We at GLK Law extend our deepest condolences to the family of the woman who died in this accident. Any person who may have more information about what happened should reach out to the police. This was a preventable tragedy that should have never taken place.
