Speeding remains one of the leading causes of car accidents across New York and the United States. According to NY Veh & Traf L § 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” There are many different ways that a driver may have acted negligently and caused a crash.
Drivers have a legal obligation to exercise due care to avoid colliding with other vehicles in the roadway. There is a presumption of negligence on the part of any driver that fails to slow down to avoid colliding with a car ahead of them. Depending on the specific facts of any accident, there could be several liable parties. Any person that is injured in a Bronx car accident may be able to pursue damages through a personal injury claim.
