Liability For New York City Apartment Fires

Residential fires remain a leading cause of serious injury and death in the United States. According to the National Safety Council, “One- and two-family home fires account for 59.1% of civilian deaths and 54.3% of injuries. Apartment structure fires account for 12.4% of deaths and 20.8% of injuries. For overall home fires, the 2022 rate of 7.5 deaths per 1,000 reported home fires was 6% higher than the rate of 7.1 in 1980, but a decrease of 5% from 2021.” There are many common causes of apartment fires.

  • Cooking accidents
  • Heating equipment
  • Electrical problems
  • Faulty appliances

Depending on the facts of any case, the owner of an apartment building could be liable for a fire. Property owners have a legal obligation to maintain their buildings in a reasonably safe condition. This includes being compliant with all NYC fire codes. Failure to maintain a property in a reasonably safe condition could form the basis of a negligence claim. For example, a building may have lacked the required smoke detectors or sprinklers. Victims of apartment fires tend to suffer very serious injuries, including:

  • Lung damage
  • Burn juries
  • Cardiac arrest
  • Death

The vast majority of apartment fires are preventable. It is important to determine why any fire took place. There could be some negligence in how a fire started. For example, a fire may have started due to faulty electrical wiring. There may also be negligence by a building owner who fails to follow safety codes. Any person injured in an apartment fire may be able to seek some level of justice through a civil claim.
