Liability for Kensington Car Accidents

Car accidents remain one of the leading causes of preventable injury and death in the United States. According to the IIHS, “Although the U.S. population has grown continuously since 1975, the rate of crash deaths per 100,000 people in 2022 was 38% lower than it was four decades ago. In 2022, the overall per capita death rate decreased 2.1% compared with 2021.” There are several factors that could contribute to a car accident.

  • Car accidents are more likely during the early morning and late evening hours when visibility is reduced.
  • Car accidents are more likely when one or more driver is speeding.
  • Car accidents often involve drivers under the influence of alcohol or drugs.

Drivers have a legal obligation to operate their vehicle in a safe manner in order to avoid collisions. They should only travel at a speed that would be safe and reasonable given the prevailing conditions of the roadway. If a driver fails to slow down in order to avoid hitting another vehicle, this could form the basis of a negligence claim. It is important that several steps are taken after any car accident.

  • Photos of the accident site should be taken.
  • Medical records related to the accident should be preserved.
  • Surveillance footage should be sought.
  • An experienced car accident attorney should be contacted.

Car accidents are often highly preventable. They often involve drivers who are failing to follow traffic regulations. It is important that accident victims seek medical attention as early as possible after a crash. Many of the injuries associated with collisions are not immediately obvious. Any person injured in a New York City car accident may be able to seek some measure of accountability through a bodily injury claim.
