Liability For Bronx Scooter Accidents

Scooters and electric bikes have become incredibly popular. But this rise in popularity has coincided with a rise in accidents. According to one report from Business Insider, “there have been at least 1,545 accidents in the US involving electric scooters over the past year (2018).” There are a number of common causes of scooter accidents.

  • Scooters have a naturally small profile and are more likely to be overlooked by other drivers.
  • Most scooter accidents happen in dense urban areas where there is heavy traffic.
  • A large portion of serious injury and fatal collisions involve drivers who were speeding or intoxicated.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians and scooter riders. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting scooter drivers, this could form the basis of a negligence claim. It is important to consider the circumstances of any collision.

  • Surveillance footage should be sought.
  • The scooter involved in the crash should be examined.
  • The police report for the collision should be collected.
  • Photos of the accident site should be taken.

The vast majority of scooter accidents are preventable and involve some amount of human error. Sadly, drivers and their insurance providers will often do everything in their power to deny liability for crashes. It is important for accident victims to understand that they do have rights. The family of any person who died in a scooter accident may have legal recourse through a civil claim.
