Liability For New York City Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured in collisions every year. According to the Centers for Disease Control, “Nearly 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2021. That’s about one death every 66 minutes. One in six people who died in crashes in 2021 were pedestrians.” There are a number of measures that cities can take in order to prevent pedestrian accidents.

  • Cities should heavily enforce traffic infractions likely to lead to pedestrian collisions.
  • Cities should install pedestrian islands.
  • Cities should regularly inspect and maintain pedestrian infrastructure.

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. To that end, drivers must slow down in areas with heavy pedestrian traffic. Most collisions tend to happen at intersections. Left turns can be particularly deadly for pedestrians. It is important for accident victims to understand that they do have rights.
