Bergen County officials are saying that the accident took place on Tuesday. The painter was working at a two-story home when he fell.

Liability for Bergen County Ladder Accidents

Falls remain one of the leading causes of preventable injury and death for workers. According to the National Safety Council, “In 2022, 865 workers died in falls, and hundreds of thousands were injured badly enough to require days off of work. A worker doesn’t have [to] fall from a high level to suffer fatal injuries; 144 workers were killed in falls on the same level in 2022, according to Injury Facts.” Many steps should be taken to prevent falls in the workplace.

  • All workers should receive training to identify fall hazards.
  • Workers should be provided with personal fall arrest systems when working at heights of 6 feet or more.
  • Ladders used at job sites should be routinely inspected and well-maintained.

When a worker is injured in New Jersey, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme that helps workers who have been injured. In addition to workers’ compensation, injured workers may also be able to pursue damages through a third-party liability claim. There could be numerous sources of third-party liability for any ladder fall accident.

  • The company that manufactured a ladder could be held at-fault through a product liability claim if it was defective.
  • A general contractor may face some liability if a worksite was not maintained in a reasonably safe condition.
  • It is also possible that the property owner could be liable for any accident as well.

Victims of ladder fall accidents often suffered very serious injuries. They may need to take long periods of time away from work. In many cases, they may not be able to return to their previous profession due to the severe nature of their injuries. It is important for these victims to understand that they do have legal options. They’re able to seek some measure of accountability through a civil action.
