Investigation Underway After One Person Killed, Three Injured in West Seneca Car Accident Following Police Pursuit

WEST SENECA, NEW YORK (September 24, 2026) – One person has died and three people were injured in a West Seneca car accident on Harlem Road.

West Seneca officials are saying that the collision occurred around 7:15 PM on Tuesday night. Police officers said that a driver fled a traffic stop at a high rate of speed.

Responding officers initiated a pursuit before the driver involved collided with a vehicle traveling northbound. The force of that collision caused a pickup truck to overturn and catch fire.

Sadly, the driver of the pickup truck died due to the severe nature of his injuries. Three other people were transported to the hospital.

A full investigation into these circumstances leading up to the crash remains ongoing.

Liability for West Seneca Police Pursuit Accidents

Far too many people are seriously injured or killed every year in preventable accidents involving police pursuits. According to JAMA Network, “Between 2009 and 2023, there were 5425 fatal police pursuit-related crashes involving 8307 vehicles and 14 497 persons, resulting in 6352 deaths (mean [SD], 423 [84] deaths per year). Fatal crashes occurred most often in urban settings (3069 [57%]), at night (3794 [70%]), on noninterstate roads (4825 [89%]), and with documented speeding (4183 [77%]).” There are many steps police departments should take to prevent accidents during police pursuits.

• Police departments should establish and enforce clear policies relating to when officers may initiate and terminate police pursuits.
• Police officers should be educated on the danger that these pursuits pose to the general public.
• Police departments should ensure that officers are adequately supervised throughout any pursuit so that the pursuit can end if it becomes needlessly dangerous.

Police pursuits should only be used as an absolute measure of last resort. They should not be used to apprehend people suspected of minor crimes. Depending on the unique facts of any case, a police department could potentially be liable for an accident involving one of their officers. This is particularly true if an officer showed a reckless disregard for the safety of the public prior to a collision. This can include situations where officers choose to pursue suspects in densely populated urban areas.
