Liability For New York Car Accidents

The vast majority of car accidents are preventable and involve some amount of driver error. Many accidents are due to driver fatigue. According to the National Safety Council, “Driving after going more than 20 hours without sleep is the equivalent of driving with a blood-alcohol concentration of 0.08% – the U.S. legal limit. You are three times more likely to be in a car crash if you are fatigued.” Many other factors could contribute to car accidents including:

  • Dangerous left turns
  • Poor road conditions
  • Vehicle system failures
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid collisions. There is a rebuttable presumption of negligence on the part of any driver who goes past a yield sign without yielding. It is important that accident victims understand that they do have rights. Any person who is injured in a car accident may be able to seek some measure of justice through a civil claim.
