Liability For New York School Bus Accidents

Far too many people are killed or seriously injured in school bus collisions every year. According to the National Safety Council, “School bus-related crashes killed 54 people nationwide in 2020, down by over 50% compared to 2019 according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” There are many different factors that could contribute to a school bus collision.

  • Poor road conditions
  • Inclement weather
  • Faulty tires
  • Driver intoxication

Bus companies are considered common carriers under the law. Their drivers are held to a high standard in terms of safety. School buses must slow down in order to avoid collisions. If a school bus driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. It is important that accident victims take a number of steps in order to protect their rights.

  • Victims should seek medical attention as early as possible.
  • Victims should keep all medical records and traffic reports.
  • Victims should abstain from talking with insurance providers from opposing parties.
  • Victims should seek the advice of a personal injury attorney.

It can be difficult to know where to begin after any school bus accident. Many victims may not realize the full extent of their injuries right away. People are filled with adrenaline after a collision. This can mask the injuries that victims experience. Any person who is injured in a school bus accident may be able to seek some measure of justice through a civil claim.
