Liability for Clinton Residential Fires

Residential fires can be particularly dangerous and result in many preventable injuries and deaths across New York City every year. According to CBS News, “Fire deaths in New York City are up more than 60% compared to this time last year, data shows. Forty-six people have died in fires so far this year, according to FDNY First Deputy Commissioner Daniel Flynn.” There are many ways that property owners may have failed to protect against apartment fires.

  • Property owners may not have installed working smoke detectors.

  • Property owners may have failed to maintain key electrical systems.

  • Property owners may have failed to keep ingress and egress points free of clutter.

If a property owner fails to take reasonable measures to protect residents from a fire, this could serve as evidence of negligence. Depending on the facts of any case, there could be several liable parties for any residential fire. This includes a business where a fire may have originated. It also includes the company that manufactured lithium-ion batteries or other consumer products. Any person injured in a residential fire is able to seek some measure of accountability through a civil claim.
