Liability for Monmouth County School Bus Accidents

School buses are normally very safe. But many people are still injured in school bus collisions each year. According to the National Safety Council, “School bus-related crashes killed 104 people nationwide in 2022, down 3.7% compared to the 108 deaths in 2021, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” School bus drivers should take a number of measures in order to avoid collisions.

  • School bus drivers should be well rested before heading out onto the road.
  • School bus drivers should ensure that their vehicles are properly maintained.
  • School bus drivers should continuously scan the road ahead of them for hazards.

All drivers have a legal obligation to exercise care in order to avoid colliding with other vehicles on the roadway. There is a rebuttable presumption of negligence on the part of any driver that crosses into opposing lanes of traffic and collides with another vehicle. If the driver of a commercial vehicle caused an accident, their employer could potentially be held at fault. Generally speaking, employers are vicariously liable for the wrongful actions of their employees. It is important that certain steps are taken after any school bus accident.

  • The police should be called to the scene so that they can begin an investigation.
  • Accident victims should seek medical treatment for all of their injuries.
  • Medical records related to any injuries should be collected.
  • An experienced school bus accident injury attorney should be contacted.

It could be hard to know where to begin after any bus accident. Victims are often seriously injured in ways that impact their lives far into the future. In many cases, a serious bus accident can impair a person’s ability to perform everyday activities and simply live a normal life. Any person that is injured in a school bus accident may be able to seek some measure of accountability through a personal injury claim.
