BROOKLYN, NEW YORK (October 11, 2024) – An MTA worker was seriously injured in an A-Line train accident south of the Hoyt–Schermerhorn Streets station.

New York City officials are saying that the incident took place early Thursday morning. An MTA worker was performing his duties as a flagger when he was hit by an A-Line train.

Firefighters and paramedics were called to the scene in order to help the victim. He was taken to the hospital with major injuries.

A full investigation into the cause of the collision remains ongoing at this time.

Liability For Brooklyn MTA Train Accidents

Thousands of workers are seriously injured or killed in collisions every year in the United States. According to OSHA, “There were 5,486 fatal work injuries in 2022 (3.7 fatalities per 100,000 full-time equivalent workers).” There are a number of common causes of workplace accidents.

  • There may be poor communication between workers.
  • Workers may not be provided with adequate safety gear.
  • Work sites might be maintained in an unsafe condition.

All employers in New York have a legal obligation to provide their workers with a reasonably safe environment. Pursuant to New York Labor Law 200, construction companies must provide workers with a reasonably safe environment for employees and those lawfully frequenting work sites. The statute requires, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” Victims of train accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

MTA accidents tend to be entirely preventable. They are often the result of systemic failures at a worksite, as opposed to the negligent actions of a single person. Any person injured in an MTA accident may be able to seek some measures of justice through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
