Liability For Manhattan Car Accidents

Motorcyclists lack the protection of enclosed vehicles and are uniquely vulnerable in car accidents. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022.” Drivers should take a number of measures in order to avoid hitting motorcycles.

  • Drivers should slow down during heavy traffic.
  • Drivers should constantly scan the road ahead of them.
  • Drivers should check their blind spots before making turns.

All drivers have a legal obligation to exercise due care in order to avoid hitting other vehicles. To that end, drivers must slow down during periods of inclement weather and heavy traffic. There is a rebuttable presumption of negligence on the part of any driver that fails to slow down to avoid a vehicle in their lane. Victims of motorcycle accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Car accidents are often highly preventable. They tend to occur when drivers are distracted or speeding. Any person that is injured in a Manhattan car accident may have legal recourse through a civil claim. Damages in a civil claim can help victims recover for their injuries and lost wages. A car accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
