Liability for New York City Motorcycle Accidents

Thousands of motorcyclists are killed or seriously injured every year in collisions across the United States. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 15.5% of all traffic fatalities and 3.4% of all injuries in 2023.” Drivers should take several measures to avoid colliding with motorcyclists.

  • Drivers should check their blind spots before changing lanes.
  • Drivers should continuously scan the road ahead of them for hazards.
  • Drivers should abstain from alcohol and other intoxicating substances.

Every driver must use caution in order to avoid colliding with any motorcyclist or vehicle in the roadway. This may necessitate that they travel far below the stated speed limit. In particular, motorcycle collisions are much more likely to occur in stop-and-go traffic. If a driver fails to slow down to avoid colliding with a motorcyclist, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

Motorcycle accidents are often highly preventable. Part of the problem is that motorcycles have a low profile and are more likely to be overlooked by other drivers. This is particularly true in the early morning and at night. Any person injured due to the negligent actions of another driver may be able to seek some measure of accountability through a civil claim.
