Liability for Sussex County Dump Truck Accidents

Trucks are involved in thousands of fatal collisions each year. According to the National Safety Council, “In 2023, 5,375 large trucks were involved in a fatal crash, an 8.4% decrease from 2022 but a 43% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is down 8% from 2022, but up 22% in the last 10 years.” There are many factors that could contribute to any truck collision.

  • Truck collisions are much more likely to occur if drivers are speeding.
  • Many truck collisions happen in the early morning and late evening when visibility is reduced.
  • Driver fatigue is another major cause of truck accidents.

Truck drivers have a legal obligation to use caution to avoid colliding with other vehicles in the roadway. They must maintain their vehicle at a safe speed at all times. This may necessitate that they travel well below the speed limit, depending on the prevailing road conditions. If a driver fails to slow down to avoid colliding with another vehicle, this could form the basis of a negligence claim. It is important that certain steps are taken after any car accident.

  • Photos of the accident site should be taken.
  • The police should be called to the scene so that they can investigate.
  • The contact information of eyewitnesses should be collected.
  • An experienced personal injury attorney should be contacted.

Car accidents are often highly preventable. In fact, it has been estimated that 93% of collisions involve some amount of human error. Any person injured due to the negligence of another driver may have legal recourse. This extends to the surviving family members of any person killed. They’re able to see some measure of justice and accountability through a wrongful death action.
