Liability For Queens Car Accidents

Speeding remains one of the leading causes of car accidents across New York and the nation. According to the National Highway Traffic Safety Administration, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2022, speeding was a contributing factor in 29% of all traffic fatalities.” There are a number of reasons that speeding can increase the likelihood of car accidents.

  • Drivers are more likely to lose control at higher rates of speed.
  • Drivers have longer stopping distances at higher rates of speed.
  • Drivers are less able to perceive hazards in the roadway at higher rates of speed.

All drivers must exercise a great deal of care in order to avoid collisions. Pursuant to New York Vehicle & Traffic Law § 1180, no person is allowed to operate a motor vehicle faster than what would be prudent or safe given the prevailing conditions of the roadway. If a driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. There are many other factors that could contribute to a collision.

  • Drunk driving
  • Distracted driving
  • Vehicle system failures

The vast majority of car accidents are preventable. Drivers often speed so that they can get to their destination slightly faster. But this is never worth it. It is better to slow down and be safe. It is important for victims of car accidents to understand that they do have rights. The family of any person injured in a car accident may be able to seek some measure of justice through a civil claim.
