Pedestrian Died in Flatbush MTA Bus Accident by Nostrand Avenue and Clarendon Road

FLATBUSH, BROOKLYN (September 9, 2026) – A 58-year-old man has tragically died in Flatbush, Brooklyn, after being hit by an MTA bus near the intersection of Nostrand Avenue and Clarendon Road.

New York City Police Department officials are saying that the collision occurred around 8 PM on Saturday night. The pedestrian was walking and just stepped off the sidewalk as they were hit by a bus that was pulling away.

Apparently, the man was run over by the rear wheels of the bus. Paramedics were called to the scene to help the injured victim.

Unfortunately, the injuries that he sustained were so severe that he was not able to be saved. The bus driver involved remained at the scene and cooperated with the police.

Liability for MTA Bus Accidents

Bus drivers in New York City are considered common carriers and are expected to operate within an abundance of caution to avoid collisions. They must be particularly cautious when encountering any pedestrian in the roadway. Under New York Vehicle and Traffic Law § 1146, “every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” Courts will review a number of different factors when examining who could be liable for a car accident.

If a bus driver fails to slow down to avoid hitting any pedestrian, they could be held legally responsible for any resulting injuries. Legal responsibility could also extend to the private or municipal entity that owned the bus. Under New York law, employers are legally responsible for the negligent actions of their workers when they are operating within the course and scope of their job duties.
