Liability For Crawford Semi-Truck Accidents

There are many factors that could contribute to car accidents. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are a number of measures that semi-truck drivers should take in order to avoid collisions.

  • Semi-truck drivers should be well rested before the start of their shift.
  • Semi-truck drivers should abstain from alcohol and other intoxicating substances.
  • Semi-truck drivers should have their vehicles periodically inspected and well maintained.

The vast majority of semi-truck accidents are preventable and involve some amount of driver error. Pursuant to New York Vehicle & Traffic Law § 1163, “No person shall turn a vehicle at an intersection […] or move right or left upon a roadway unless and until such movement can be made with reasonable safety.” There is a rebuttable presumption of negligence on the part of any driver who leaves their lane of traffic and hits another vehicle. Victims of truck accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Death

If a semi-truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. The family of any person who died in a semi-truck accident may be able to seek some measure of justice through a wrongful death claim. A truck accident attorney can examine the unique facts of your case and let you know what your legal options are.
