New York City Police Department Investigating Brooklyn Car Accident Involving Elderly Pedestrian and Department of Transportation Truck
BROOKLYN, NEW YORK (June 24, 2024) – An 86-year-old man has tragically died after being hit by a Department of Transportation (DOT) truck in Bay Ridge, Brooklyn.
New York City officials are saying that the collision took place around 3:30 p.m. on Wednesday. An elderly pedestrian was crossing the street when he was hit by a DOT truck.
Paramedics were called to the scene in order to help the victim. But he was pronounced dead at the scene. A full investigation into the Bay Ridge truck accident remains ongoing at this time.
Pedestrians have a small profile and are uniquely vulnerable to the hazards posed by trucks. According to the IIHS, “A total of 7,388 pedestrian deaths occurred in 2021. Pedestrian fatalities increased 13% from 2020, and account for 17% of all crash fatalities. Although pedestrian deaths were 2% lower in 2021 than in 1975, they have increased 80% since reaching their lowest point in 2009.” Truck drivers should take a number of measures in order to prevent collisions.
All truck drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a truck driver fails to take evasive action to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps be taken after any pedestrian collision.
Pedestrian accidents tend to occur most often on a relatively small number of roads and intersections. These tend to be in areas with heavy pedestrian traffic. Drivers are supposed to slow down and remain alert when pedestrians are nearby. But far too often this does not happen.
