Liability for Brooklyn Apartment Fires

Residential fires remain one of the leading causes of preventable injury and death in the United States. According to the National Fire Protection Association, β€œIn 2023, local fire departments responded to an estimated 1.39 million fires in the United States. These fires caused an estimated 3,670 civilian fire deaths and 13,350 reported civilian fire injuries. The property damage caused by these fires was estimated at $23 billion.” Apartment owners should take several steps to prevent fires.

  • Apartment owners should ensure that smoke alarms are installed.
  • Apartment owners should ensure that appliances are properly maintained.
  • Apartment owners should ensure that flammable materials are properly stored.

All property owners in New York have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for the sake of all people whose presence on a property is reasonably foreseeable. If a property owner has actual or constructive notice of a dangerous condition with a property, they must take action. It is important that certain steps are taken after any residential fire.

  • The source of the fire should be determined.
  • Eyewitnesses should be interviewed.
  • Maintenance records for the building should be reviewed.
  • An experienced personal injury attorney should be contacted.

Apartment fires could be caused by many different things. This may include cooking accidents and poorly maintained appliances. Even if a fire is unavoidable, there are still steps that apartment owners can take to prevent injuries. This includes installing smoke alarms to warn people. Any person injured in a residential fire may have legal recourse through a civil claim.
