Liability for Long Island School Bus Accidents

School buses are normally very safe for passengers, but they can be particularly dangerous for pedestrians. According to the National Safety Council, “School bus-related crashes killed 128 people nationwide in 2023, up 23% compared to the 104 deaths in 2022, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” School bus drivers should take several measures to avoid hitting pedestrians.

  • School bus drivers should maintain a safe speed at all times and take into consideration prevailing conditions.
  • School bus drivers should use their horns when necessary to alert pedestrians of their presence.
  • School bus drivers should abstain from medications that could impair their ability to drive safely.

School bus companies are considered common carriers. Their drivers must use an abundance of caution to avoid hitting pedestrians and other drivers. If a school bus driver fails to slow down to avoid hitting a pedestrian, this could be construed as negligence. The company that the bus driver worked for could be held at fault. Generally speaking, employers can be liable for the wrongful actions of their workers who were operating within the course and scope of their job duties.
